These general terms and conditions shall govern your attendance of, or participation in, Samsung Foundry Forum & SAFE Forum 2024 (“Event”) hosted and organized by Samsung Electronics Co., Ltd. ("Samsung"), either in-person or online through the official website https://semiconductor.samsung.com/events/foundry-events/(“SFF/SAFE Forum Website”) and together shall constitute an agreement between you and Samsung. You may only register for and attend the Event in accordance with these terms and conditions. If you have any questions about the terms and conditions, or do not agree to them, then please email us at info@samsungfoundryevent.com, before using the website. By using SFF/SAFE Forum Website, you signify your agreement to these terms and conditions, and the Privacy Policy terms presented in the following page.

Samsung may change these terms and conditions or its privacy policy at any time by updating this page. You shall therefore check this page from time to time to review these terms and conditions to ensure that you agree with any changes. Using or accessing this website indicates your continuing acceptance of any updates to the terms and conditions. If you do not accept the terms and conditions, then please do not continue to use the website.

  1. 1. Attendance of the Event, Access to the Website and Samsung Intellectual Property Rights

    The Event and the SFF/SAFE Forum Website allow you to use the Contents (defined below) contained within it for your own use and benefit subject to the terms and conditions herein. Samsung shall have the right to modify, withdraw or deny your access to the Event or the SFF/SAFE Forum website at any time, including introducing charges for its use or other restrictions on access.

    The information, documents, and other materials ("Content") presented at the Event or contained within the SFF/SAFE Forum website are provided "as is" and are given for general information and interest purposes only. Samsung updates the Content from time to time, but Samsung is not responsible for any errors, faults or inaccuracies. You should not therefore rely on the Content, and Samsung recommends that you take further advice or seek further guidance before taking any action based on it. You expressly agree and acknowledge that you use the Content at your sole risk and Samsung assumes no liability or responsibility for any user content or information provided by other users of the website.

    The website and all the materials contained within it or made available by Samsung in connection with the Event, including without limitation, notes, records, reports, brochures or other documents and tangible items, belong to Samsung or Samsung’s licensor(s), and are protected as such by intellectual property rights (including, but not limited to, copyright, trademarks, patents, design rights, database rights, and rights in confidential information). The materials include, but are not limited to, the design, layout, logos, brands, look, appearance and graphics of the website, plus Content such as software, documents and other materials which appear on it. You may not copy, redistribute, republish or otherwise make the materials on the website available to anyone else for a commercial purpose without prior consent of Samsung in writing.

    You may only share materials obtained at the Event or printed or downloaded from the website for your own personal, non-commercial use, provided that:

    • no materials are modified in any way
    • no graphics are used separately from accompanying text
    • copyright and trademark notices appear in all copies, and you acknowledge this website as the source of the materials and
    • the people to whom you provide these materials are made aware of these restrictions.

    Notwithstanding the foregoing, specific license terms for materials on the website may allow broader rights of use, subject to such terms.

    Nothing in these terms and conditions grants any license to use any Samsung brand. However, you may be entitled to use the logo of Samsung Foundry Forum and some designed elements in accordance with our guidance that may be updated from time to time.

    To the fullest extent permitted by law, we expressly exclude all representations, conditions, warranties or other terms which apply to such Content/information, including any implied warranties of satisfactory quality, merchantability, fitness for a particular or any purpose, and non-infringement which might otherwise apply but for this clause.

    If, in a relevant jurisdiction, these limitations and exclusions are not permitted, then our liability shall be limited and excluded to the fullest extent permitted by law.

  2. 2. Safety and Security

    Your safety and security is important to us. You acknowledge that you will follow all instructions and/guidelines issued by Samsung at all times during the Event. We also reserve the right to ask you to leave the Event if your behavior causes us concern for the safety or security of Event attendees.

    Samsung reserves the right, including without prior notice, to limit the number of Event attendees and participants, to cancel or terminate any Event registration, to bar any person from attending all or any part of the Event, and to refuse to provide any person with access to Event materials.

  3. 3. Samsung Goods and Services

    Samsung may display the availability of some goods and/or services at the Event or on this website. Some of these goods and/or services may only be available in certain jurisdictions and Samsung therefore reserves the right to choose where such goods and/or services are supplied. By informing the availability of any goods and/or services, Samsung does not warrant that such goods and/or services will be available in your jurisdiction and you should check with your local Samsung contact for further information. Where Samsung does supply goods and/or services, whether through this website or other means, additional terms and conditions may apply.

  4. 4. Assumption of Risk; Liability

    Your attendance of or participation in the Event or any related activities is completely voluntary. Samsung does not guarantee your admission to all or any part of the Event (including any session, keynote or other activity). To the maximum extent permitted under applicable law, you accept and assume all risks of any and all personal injury or damage to your personal property that you may face while attending the Event, and hereby waive any claims you may have against Samsung and its affiliates, Event sponsors or vendors relating to such risks.

    Samsung does not guarantee that the SFF/SAFE Forum website or any product and/or services provided at the Event or through the SFF/SAFE Forum website:

    • will be compatible with all or any hardware and software which you may use
    • will be available all the time or at any specific time.

    By attending the Event or using the SFF/SAFE Forum Website, you agree to indemnify Samsung, and other companies and corporations in the Samsung group, against any costs, damage, claims, liabilities and expenses incurred as a result of your breach of these Terms and Conditions, the Privacy Policy, and/or any other applicable terms.

    SAMSUNG AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF GOODWILL. SAMSUNG AND ITS AFFILIATES’ AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED USD $100. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

    Samsung may link to other websites which are not within its control. When possible, Samsung will note that you are leaving the SFF/SAFE Forum website. Samsung is not responsible for these other sites in any way, and does not endorse them. It is your responsibility to check the terms and conditions and privacy policy on any other site which you visit.

  6. 6. Fees

    Attendance of the Event and the use of SFF/SAFE Forum website services are free of charge. Samsung reserves the right to charge for the Event or SFF/SAFE Forum website services and to change its fees, at its discretion. Samsung may from time to time launch other services which may be subject to a separate charge and terms.

  7. 7. Contracting Online

    Neither your attendance of the Event nor anything on the SFF/SAFE Forum website is intended to be, nor should be construed as, an offer or acceptance to enter into a contractual relationship with you or anyone else, except for these terms and conditions, which govern the relationship between us in relation to your attendance of the Event and/or use of the SFF/SAFE Forum website and the services made available through it (plus any additional terms we impose in relation to specific products and/or services offered at the Event or on the website).

    If you enter into a contract with a third party who is named or referred to at the Event or on the SFF/SAFE Forum website, Samsung takes no responsibility with respect to such action and it is your responsibility to ensure that you are comfortable with the terms of that contract, and to take legal advice if necessary.

  8. 8. Personal Release

    Samsung (and/or others on behalf of Samsung) may be photographing, recording (both audio and video), webcasting or otherwise transmitting during any or all of the Event (including at the Event venue during an Event session, breakout, keynote or other activity). Your image, likeness, voice, statements and other identifying characteristics (each, an “Image”) may be captured in photographs, recordings (both audio and video), webcasts or other transmissions of the Event (each, a “Recording”).

    You hereby grant to Samsung a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable and fully sublicensable (through multiple tiers) license, without additional consideration to you or any third party, to reproduce, distribute, perform and display Recordings (including your Images therein), in whole or in part, in any format or media now known or hereafter developed, and for any purpose.

    Samsung exclusively owns all right, title and interest (including intellectual property rights) in and to the Recordings, all modifications and derivatives of Recordings, and all proceeds derived therefrom. Samsung has no obligation to share any such proceeds with you.

    In connection with Samsung’s use or other exploitation of Recordings (including your Images), you hereby irrevocably waive and release any and all claims with respect to intellectual property, rights of publicity, rights of privacy, and any other claims or damages with respect to such use or other exploitation. You affirm that you are of legal age and have read the foregoing release and fully understand its contents.

  9. 9. Changes to Event

    The Event is subject to change at any time. Samsung does not guarantee the attendance of any third party (including any exhibitor or speaker), or that any scheduled session, keynote or other activity will take place.

    Samsung reserves the right, including without prior notice, to cancel or postpone the Event or make any change to an Event program at any time for any reason (including modification of the schedule or content of, or cancellation of, any session, keynote or other activity). Samsung is not responsible for, and no reimbursement will be issued in the event of, any change to the Event (including modification of the overall Event program, or the schedule or content of, or cancellation of, any session, keynote or other activity).

  10. 10. Governing Law and Jurisdiction

    The formation, existence, construction, performance, validity and all aspects whatsoever of these terms and conditions, or of any individual one of these terms and conditions, will be governed by the laws of the Republic of Korea. The Seoul Central District Court will have exclusive jurisdiction to settle any disputes which may arise out of, or in connection with, these terms and conditions, your attendance of the Event or the use of the SFF/SAFE Forum website.

  11. 11. Age Limit

    I acknowledge that I am above the age of majority of the country that the Event is being held and agree to all these terms and conditions prior to attending the Event (either in-person or online).

    Everyone is welcome to visit the SFF/SAFE Forum website. However, if you want to participate on certain sections of the website or in certain activities available on the website (for example, join a club or group or enter a contest), you must register to the website. In order to register, you must be at least 18 years old or receive your parents and/or guardians written consent.

  12. 12. SURVIVAL

    Sections 1, 3-5, 8-10, and 12 of these terms and conditions will survive termination of the Event or these terms and conditions.

  • To whom do we disclose your information?

    • companies that provide services for or on behalf of us, such as companies that help us with the billing process;

  • What do we do to keep your information secure?

    We have put in place reasonable physical and technical measures designed to safeguard the information we collect in connection with the Business Services.

  • Where do we transfer your information?

    Your use or participation in the Business Services may involve transfer, storage and processing of your information outside of your country of residence, consistent with this policy. Please note that the data protection and other laws of countries to which your information may be transferred might not be as comprehensive as those in your country. We will take appropriate measures, in compliance with applicable law, which are designed to ensure that your personal information remains protected.

  • What are your rights?

    Under the laws of some jurisdictions, you may have certain rights with respect to your personal information, including the right to request details about the information we collect about you, delete information collected about you, and to correct inaccuracies in that information.     If you request deletion of personal information, you may not be able to access or use the Business Services, and residual personal information may continue to reside in Samsung's records and archives for some time, but Samsung will not use that information for commercial purposes. Where permitted under applicable law, Samsung reserves the right to keep your personal information, or a relevant part of it, if Samsung has suspended, limited, or terminated your access to the Business Services for violating the Samsung Terms of Use, when necessary to protect the rights, property, or safety of Samsung, or any of our respective affiliates, business partners, employees or customers.

    The Business Services may offer choices related to the collection, deletion and sharing of certain information and communications about products, services and promotions.   • How long do we keep your information?

    We take reasonable steps designed to ensure that we retain information about you only for so long as is reasonably necessary for the purpose for which it was collected, as described in this Samsung Semiconductor Privacy Policy or any other notice provided at the time of collection, taking into account statutes of limitation and records retention requirements under applicable law, as well as our records retention requirements and policies.

  • Cookies, Beacons and Similar Technologies

    We, as well as certain third parties that provide content, advertising, or other functionality on our Business Services, may use cookies, beacons, and other technologies in certain areas of our Business Services.

    • Cookies

      Cookies are small files that store information on your device. They enable the entity that put the cookie on your device to recognize you across different websites, services, devices, and/or browsing sessions. Cookies serve many useful purposes. For example:
